We reserve the right to change the terms of this Policy at any time for any reason. Please review this Policy from time to time to make sure you understand it and any changes. By providing your mobile phone number, you are consenting to receive recurring automated text messages and automated calls from the Campaign with news, updates, event alerts, volunteer opportunities or related information. Your opt-in data and consent will not be shared with third parties except as required by law.

- The contribution is not being made on behalf of a foreign national or entity prohibited from making contributions under federal or Texas law;
- The Campaign will collect, record and report your name, address, occupation and employer (or name of employer) if required by law;
- Political contributions are not deductible for federal income tax purposes.
7. Representations
You warrant that any information you provide when making a contribution or using our services is accurate, complete and truthful.
8. Liability and Indemnification
In consideration of your use of the website and services, you agree to indemnify and hold harmless the Campaign, its employees, directors, officers, volunteers, agents and affiliates from and against any and all claims, liabilities, costs, or damages (including attorneys’ fees) arising from your use of the website or your violation of these Terms. The Campaign reserves the right to assume the exclusive defense and control of any matter subject to indemnification.
9. Processing Funds
If you make a contribution online, your credit or debit card will be charged immediately (or as specified). For security reasons, the Campaign does not store your credit card information; we securely transmit it to our payment processor.
10. Refunds
We will make reasonable efforts to refund contributions in cases such as duplicate donations or input error, but the Campaign reserves the right to deny refund requests. All refund requests must be made promptly and are subject to availability of funds and ability to recover funds.
11. Intellectual Property
All content on the website (including text, graphics, logos, images, videos, trademarks and service marks) is the proprietary property of the Campaign and/or its licensors. You are granted no rights to reproduce, copy, modify, distribute, display or create derivative works of any portion of the website or content except as expressly authorized in writing by the Campaign.
12. Disclaimer of Warranties
Your use of the website and services is at your own risk. The website and services are provided “as is” and “as available,” with no warranties of any kind, either express or implied. The Campaign specifically disclaims any and all warranties of merchantability, non-infringement, or fitness for a particular purpose.
13. Limitations of Liability
To the fullest extent permitted by law, the Campaign, its directors, employees, partners, suppliers or content providers will not be liable for any indirect, incidental, punitive, special, or consequential damages (including but not limited to lost profits, data loss, or cost of substitute services) arising out of your access to, use of, or inability to access or use the website or services. In no event shall the Campaign’s liability for direct damages exceed one hundred U.S. dollars (USD $100.00). Some jurisdictions do not allow certain limitations of liability, so this limit may not apply to you.
14. Dispute Resolution, Governing Law and Arbitration
We encourage you to contact us before resorting to litigation. But if a dispute does arise, these Terms and the Privacy Policy will be governed by the laws of the State of Texas and the United States, without regard to conflicts of law principles, and without application of the Uniform Computer Information Transactions Act or the United Nations Convention on Contracts for the International Sale of Goods. You agree that the Campaign is deemed a passive website and does not give rise to personal jurisdiction over the Campaign’s officers or agents in any jurisdiction other than the State of Texas.
Any dispute arising out of or relating to these Terms shall be settled by binding arbitration administered by the American Arbitration Association, in accordance with its Commercial Arbitration Rules in effect at the time. The arbitration shall be held in Travis County (or another county designated by the Campaign) in the State of Texas. If the amount in controversy exceeds five-hundred thousand U.S. dollars (USD $500,000), arbitration shall be conducted under the Procedures for Large, Complex Commercial Disputes.
15. Miscellaneous
These Terms and the materials referenced in them constitute the entire agreement between you and the Campaign with respect to the website and services and supersede all prior communications and proposals (whether oral, written or electronic). If any provision of these Terms is found to be invalid under applicable law, that provision shall be deemed limited or eliminated to the minimum extent necessary so that the remainder of the Terms remains in full force and effect. The failure of either party to enforce any right under these Terms shall not be deemed a waiver of that right.
These Terms are personal to you. You may not assign, transfer or sublicense them without our prior written consent. The Campaign may assign, transfer or delegate any of its rights and obligations under these Terms without your consent, and we will provide notice of such assignment via email, website posting or other written notice.
